About our privacy policy
By MSD cares deeply about your privacy. We therefore solely process data required for (the improvement of) our services, and we handle the information gathered about you and your use of our services with the utmost care. We never make your data available to third parties for commercial purposes.
This privacy policy applies to the use of the website and the services accessible through it provided by ByMSD. The effective date of these terms is 03/04/2022; the publication of a new version invalidates all previous versions. This privacy policy describes which data about you is collected by us, what this data is used for, and with whom and under which conditions this data may be shared with third parties. We also explain to you how we store your data, how we safeguard your data against misuse, and what rights you hold regarding the personal data you have entrusted to us.

About data processing
Below, you can read how we process your data, where we store it (or have it stored), which security measures we employ, and who has access to the data.
Webshop software
WooCommerce
MijnWebwinkel
Our webshop has been developed using WooCommerce software. Personal data that you provide to us for the purpose of our services is shared with this party. WooCommerce has access to your data to offer us (technical) support; they will never use your data for any other purpose. WooCommerce is obligated, pursuant to the agreement concluded with them, to take appropriate security measures. WooCommerce uses cookies to collect technical information regarding your use of the software; no personal data is collected and/or stored.
Web hosting
SiteGround
We purchase web hosting and email services from SiteGround. SiteGround processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata about the use of the services. This does not constitute personal data. SiteGround has taken appropriate technical and organizational measures to prevent the loss and unauthorized use of your personal data. SiteGround is bound by a duty of confidentiality under our agreement.
Email and mailing lists
MailChimp
Our website makes use of MailChimp, a third party that manages the email traffic originating from our website and handles the dispatch of any newsletters. All confirmation emails you receive from our website and web forms are dispatched via the servers of MailChimp. MailChimp will never use your name and email address for its own purposes. At the bottom of every automated email sent via our website, you will find the ‘unsubscribe’ link. If you click this, you will no longer receive emails from our website. Please note that this may significantly reduce the functionality of our website! Your personal data is securely stored by MailChimp. MailChimp employs cookies and other internet technologies that provide insight into whether emails are opened and read. MailChimp reserves the right to use your data to further improve its services and, within this context, share information with third parties.
SiteGround
For our regular business email communications, we rely on the services of SiteGround. This party has implemented appropriate technical and organizational measures to prevent the misuse, loss, and corruption of your and our data as much as possible. SiteGround does not have access to our mailbox, and we treat all our
email communications confidentially.
Payment processor
Mollie
To handle (a portion of) the payments in our boutique, we use the Mollie platform. Mollie processes your name, address, and city details, alongside your payment information, such as your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to
further refine its services and, within that scope, share (anonymized) data with third parties. All aforementioned safeguards regarding the protection of your personal data also apply to the parts of Mollie's services for which they engage third parties. Mollie retains your data no longer than permitted under statutory retention periods.
Reviews
Kiyoh
We collect reviews through the Kiyoh platform. When you kindly leave a review via Kiyoh, you are required to provide your name, city, and email address. Kiyoh shares this information with us so we can link the review to your order. Kiyoh also publishes your name and city on its own website. In certain cases, Kiyoh may contact you to request clarification regarding your review. In the event that we
invite you to leave a review, we share your name and email address with Kiyoh. They use these details exclusively for the purpose of inviting you to share your feedback. Kiyoh has implemented appropriate technical and organizational measures to protect your personal data. Kiyoh reserves the right to engage third parties to deliver its services, for which we have granted
Kiyoh permission. All safeguards mentioned above concerning the protection of your personal data also apply to the parts of Kiyoh’s services for which they enlist third parties. Kiyoh retains your personal data for as long as your review remains published on the platform.
Kiyoh has appointed a Data Protection Officer; you can find their contact details on the Kiyoh website.
Shipping and logistics
PostNL
When you place an order with our house, it is our pleasure and responsibility to ensure your parcel is delivered to your doorstep. We use the services of PostNL to fulfill these deliveries. For this purpose, it is essential that we share your name, address, and city details with PostNL. PostNL uses this data solely for the execution of the delivery agreement. In the event that PostNL engages subcontractors, PostNL also makes your data available to these parties.

Purpose of data processing
General purpose of the processing
We use your data solely for the purpose of our services. This means that the purpose of the processing is always directly related to the order or request you place with us. We do not use your data for (targeted) marketing. If you share details with us and we use this data to contact you at a later stage—other than at your request—we will explicitly ask for your consent. Your data is not shared with third parties, except to comply with accounting and other statutory administrative obligations. These third parties are all bound to confidentiality under an agreement with us, an oath, or a legal obligation.
Automatically collected data
Data collected automatically by our website is processed with the aim of further refining our service to you. This data (such as your IP address, web browser, and operating system) does not constitute personal data.
Cooperation with tax and criminal investigations
Where appropriate, By MSD may be obligated under a legal requirement to share your data in connection with governmental tax or criminal investigations. In such circumstances, we are obliged to share your data, yet we will resist within the full scope that the law provides.
Retention periods
We retain your data for as long as you remain a cherished client of ours. This means we keep your customer profile until you indicate that you no longer wish to make use of our services. Should you notify us of this, we will also consider it a request to be forgotten. Under applicable administrative obligations, we are required to retain invoices bearing your (personal) details, so we will store this data for as long as the applicable statutory period runs. However, staff members will no longer have access to your client profile or the documents prepared in response to your order.
Your rights
Under applicable Dutch and European legislation, you, as a data subject, hold specific rights with respect to the personal data processed by or on behalf of us. Below, we explain what these rights entail and how you can exercise them. In principle, to prevent misuse, we only send statements and copies of your data to the email address already registered with us. Should you wish to receive the
data at another email address or, for instance, by post, we will ask you to provide proof of identity. We maintain records of fulfilled requests; in the event of a request to be forgotten, we record anonymized data. You will receive all statements and copies of data in the machine-readable format used within our systems. You retain the right at all times to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) if you suspect that we are using your personal data incorrectly.
Right of access
You always have the right to inspect the data that we process (or have processed) that relates to your person or can be traced back to you. You may submit a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send a copy of all data to the email address known to us, accompanied by an overview of the processors who hold this data, indicating the category under which we have stored it.
Right to rectification
You always have the right to have the data that we process (or have processed), and that relates to your person or can be traced back to it, rectified. You may submit a request to this effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address known to us that the data has been updated.
Right to restriction of processing
You always have the right to restrict the data that we process (or have processed) that relates to your person or can be traced back to it. You may submit a request to this effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address known to us stating that the data will no longer be processed until you lift the restriction.
Right to data portability
You always have the right to have the data that we process (or have processed), and that relates to your person or can be traced back to it, carried out by another party. You may submit a request to this effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send transcripts or copies of all data about you that we have processed, or that has been processed on our behalf by other processors or third parties, to the email address known to us. In all likelihood, we will no longer be able to continue providing our services in such a case, as the secure linking of data files can no longer be guaranteed.
Right to object and other rights
Where appropriate, you have the right to object to the processing of your personal data by or on behalf of By MSD. If you object, we will immediately cease data processing pending the resolution of your objection. If your objection is well-founded, we will provide you with transcripts and/or copies of data that we process (or have processed) and subsequently terminate processing permanently. Furthermore, you have the right not to be subject to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. Should you believe that this is the case, please get in touch with our privacy contact person.
